Facts
Daniels' (P) son was killed when his motorcycle collided with Evans' (D) car. P's son was nineteen years old. P sued to recover damages from the death of his son. The jury ruled for P. D appealed, claiming that since the boy was participating in an adult activity, he should be held to the standard of care of an ordinary person.
