Facts
D is president of Kwickie Food Stores, a chain of approximately one hundred convenience food stores. D holds a retail wine license for a Kwickie Store in Peachtree City. Jim Renew, an employee of that store, sold wine to a minor. It is undisputed that D had no knowledge of and did not authorize this sale. D was charged with the sale of alcoholic beverages to a minor pursuant and with the sale of wine on a Sunday. D was convicted of these crimes in the Municipal Court of Peachtree City, fined $200, and given 60 days in jail, with the confinement to be suspended upon the payment of the fine so long as D did not 'again violate the laws of Georgia.' The Superior Court affirmed. This appeal resulted.
