Facts

The trustee was sued for his investment in railroad stock. On May 9, 1881, the trustee bought 30 shares of stock at $119 per share. This was an investment of 1/4th to 1/5th of the whole trust fund in this stock. He purchased 20 more shares at $123 per share. Later that August, the investment went south, and this suit resulted.
