Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Dinkins (D) picked up a 14-year-old girl who was hitchhiking to a park. The girl went with D because there was another child in the car. D dropped off the other child. The girl tried to escape when she realized that D was not heading to the park. D forced her to assume a prone position and proceeded to have sexual intercourse with her against her will. D was convicted of forcible rape. D appealed: there was no evidence he used physical force to compel the girl to engage in sexual intercourse.
