Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Doe and Row were students at a parochial school in Baltimore and during their tenure at the school they were referred for counseling to the school chaplain, Father Maskell (D). According to the complaint filed, D subjected the girls to repeated sexual, physical, and psychological abuse including vaginal and anal intercourse, cunnilingus, fellatio, use of vibrators, administration of enemas, hypnosis, threats of punishment, physical violence, coerced prostitution, and other lewd acts. P also claimed that D struck her and forced her to perform sex with a police officer. These activities continued until they both left the school around 1971-72. At some point, both Ps claimed that they ceased to recall the abuse they suffered. Both Ps began to recover their memories in 1992, twenty years later. On the basis of the three-year statute of limitation, the trial judge gave summary judgment to D. This appeal resulted.
