Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Ps brought this suit to recover for damages caused by the depredations of a bull owned by D. The bull had periodically escaped and caused trouble. The statute imputed strict liability for a bull over six months caught roaming. The trial court made a number of findings of fact and conclusions of law and judgment during the trial. The court found for Ps and money damages were awarded. D appealed; the trial court was in error in taking judicial notice that the bull was over six months old.
