Gains v. State,
417 S.2d 719 (1982)
Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Three males entered a bank and robbed it. They exited the bank and went to a car where Joseph Williams (D) was sitting. There was no evidence at that time that the three males were carrying guns, masks, or money taken. They got into the car, and it pulled slowly from the lot obeying all traffic signals. One of the customers at the bank noticed the problems and followed the car. That customer waived down a police car and when the police car approached a chase ensued, and the parties were eventually apprehended after firing at the police a number of times. D was tried as a principal to the crime because it was assumed that he was the 'wheelman.' D was convicted.
