Facts

Palmer (D) was traveling down a road when he felt something hit his front bumper. D thought it was a stone and kept going until he saw Robert Gift (P), a three-year-old, lying in the street. D stopped and picked up P and returned him to his mother. P sued D for the accident. The trial judge entered a nonsuit. P appealed.
