Facts

Grouse (P) was a pharmacist at Richter Drug and was looking for a new job. P got a job offer from Group Health Plan, Inc. (D) through their chief pharmacist, Elliot. P told D that he had to give two weeks notice. D agreed and later called P to make sure he resigned. D's general manager told Elliot that he wanted a reference on P. Elliot could not obtain a reference on P and D's employment offer was withdrawn and another person was hired. P called to inform D that he was ready for work and P was told that the position was filled. P was unable to find new work for some time. P then sued D for lost wages for D's breach of contract. P's complaint was dismissed for a failure to state a claim. P appealed.
