Facts
Headly (P) wanted to collect monies due him under a contract with Hackley (D). P claimed that D owed $6,200 estimating the logs cut, hauled, and delivered under the Scribner scale. D insisted that the estimate should be according to the Doyle scale. D tried to settle the contract with a note for $4,000. P was under financial hardship and needed the money or was faced with financial ruin. P took the note. P then sued for the balance due under duress.
