Facts

Hadden (P) worked for Consolidated Edison (D) for 35 years. P was forced into early retirement for allegedly attempting to bribe a city official. P then testified under immunity that he had received $16,000 in bribes over the last few years of his employment. D revoked P's pension. P sued for breach of the agreement to award him a pension. D defended, alleging a failure of consideration due to P's unlawful actions. D appealed an award for P.
