Facts

Harrod (D) threw a hammer at his wife's paramour after a confrontation with his wife and her paramour, Calvin. The hammer lodged in the wall over D's child's crib. D then threatened his wife and Calvin with a knife. D was tried and convicted of assault against the child, who was unharmed and unaware of the act. D appealed; there can be no assault when no harm was inflicted.
