Facts

Hauser (P) was using the lavatory in Chicago, R.I. & P. Ry.'s (D) train. The coach was heated by a hot steam pipe that went along three of the walls in the lavatory. P fainted. When she awoke, she was underneath the wash basin. Her face was severely burned from resting on a hot steam pipe. P sued to recover damages, claiming that D was negligent. The jury found for P. D appealed.
