Facts
Kane took his own life on October 30, 1991. Kane was a divorced father of two college-aged children who for 5 years prior to his suicide lived with Hecht (P), a 38-year-old woman. Prior to taking his life, Kane deposited fifteen vials of his sperm in a sperm bank and authorized the sperm bank to release the specimens to P should P desire to become impregnated. Kane's will left the sperm to P as well as other property. Kane's children contested the will. They claimed he lacked mental capacity and suffered from the undue influence of P. The administrator of the estate petitioned the Court (D) for destruction of the sperm. D ordered that the sperm be destroyed. P appealed.
