Facts

P sued D to recover damages for the wrongful death of P's wife and minor daughter due allegedly to the negligence of the State Highway Department. These deaths were the result of an accident when a school bus collided with a cattle truck on a narrow bridge constructed and maintained by the State Highway Department. P sued D and D moved to dismiss. The motion was granted, and P appealed.
