Facts
Hughes (D) was drunk driving when she drove into Poole's car. Poole was nine months pregnant and expected to deliver in four days. An emergency C section was performed and when delivered the only sign of life to the baby was an extremely slow heartbeat. The child died. D was convicted of first-degree manslaughter and DUI. D got an eight-year sentence. D appealed.
