Facts

Two plaintiffs took separate actions against Alco under rule 10(b) of the Securities Exchange Act. Those actions were consolidate, and the plaintiffs decided to have the actions certified as a class action under Rule 23. The defendants opposed that motion based on four issues. The trial court granted the class certification.
