Facts

Braun (D), attorney at law, consulted with the Carusos to discuss their marital difficulties. D testified that though he first consulted with Mrs. Caruso, he felt he was counseling both of them. His fee of $100 was agreed by both. Mrs. Caruso subsequently obtained another attorney and filed a divorce against Mr. Caruso. Mr. Caruso met with and asked D to represent him in the divorce. D deferred that decision but billed Mr. Caruso $25 for Professional Services Rendered. D, a few days later, agreed to represent Mrs. Caruso and filed a substitution of attorney. Mr. Caruso complained, and D withdrew from the case.
