Facts

Sixteen-year-old D.F.B (D) was a high school sophomore with a B+ average. He appeared to be a well-adjusted young man to his teachers and peers and had no history of aggressiveness or misconduct. He was, however, depressed and had attempted suicide in the past. On February 18, 1988, D.F.B. killed both of his parent and his younger sister and brother with an ax. On the basis of this evidence, the trial court concluded that the state had not proven by clear and convincing evidence that the D.F.B. posed a threat to public safety and that he could not be treated before he turned nineteen. The court of appeals reversed, and D.F.B. then appealed to the Supreme Court of Minnesota.
