Facts

Crisan was an 87-year-old-widow who collapsed at a grocer and was taken to a receiving hospital for 14 days and then later transferred to Central hospital where she died without regaining consciousness eleven months later. A claim by the hospital was submitted, and it was allowed in the name of the city by both the probate and circuit courts. The executor of the estate appealed.
