Facts

Testator directed his executrix to employ either of two named attorneys to represent the estate, and if she failed to do so, she should be replaced by the court. The named executrix declined to serve; the testator's alternative nominee sought to employ counsel of her own choice. The designated attorneys objected. The probate court ignored the attorneys and appointed her, and the court of appeals affirmed.
