Facts

D practiced at the firm of Shapiro & Yankowitz. D’s client was being deposed by a female attorney, Mark. After a dispute D lost his temper and told Mark to “get out of here.” D walked out of the room. Yankowitz, a senior partner, appeared and Mark attempted to protest D’s actions on the record. Yankowitz then berated Marks who was eventually told to continue the deposition or leave. The deposition continued. D once again lost his temper. He told Marks: “to just do the examination and shut up, enough with the bullshit. Do the examination, or I am going to throw you out of the office. Bitch. You are the nastiest person I ever met, and I am going to really be all over you during this exam, so you better watch your ass.” Things got worse from there. The court reporter was present and witness to them. D referred to Marks as a “cunt,” an “asshole,” and advised her that she should “go home and have babies.” A judge ordered D to apologize, and another judge ordered sanctions against the firm. Yet, another judge referred D to the disciplinary committee. At the hearing for the matter, Marks stated that she thought it all was an attempt to prevent the defense from obtaining relevant information regarding an additional injury. A
