In Re Marriage Of Bush

547 N.E.2d 590 (1989)

Facts

H and W were married in 1982. They are both medical doctors. The parties had one child in 1984, and W claims that H physically and mentally abused her during and after the birth of their child. W filed for dissolution, and the trial court entered that decree on grounds of mental cruelty. W earns $7,200 per month and H earns $24,978 per month. W remarried another doctor. The final court decree joint custody with physical custody to remain with W. The court ordered H to obtain a $100,000 life insurance policy to guarantee payment of child support and ordered a trust to be established for $18,767 on behalf of the child. H was ordered to pay $800 per month and to continue to contribute to the trust an amount equal to 20% of his net income less the cost of the $100,000 life insurance policy and the $800 per month paid over the W for child support. Both parties appealed.
