Facts

International Products (P) was expecting a valuable shipment and made arrangements with Erie R.R. Co. (D) to receive and store the shipment. P inquired where D was going to store the goods; P wanted to insure them. D replied that the goods were at docked at Dock F, Weehawken. The goods arrived later and were stored at Dock D. They were destroyed by fire and P was unable to collect the insurance because of the misdescription. P sued and received judgment from the trial court. The appellate court affirmed that judgment. D appealed.
