P came to visit Mrs. Elletson, age 70, who rented an apartment from D. There was no covenant to repair by D. One of the treads on an outside stairway came loose, and P fell and sustained a fracture. The court instructed the jury as to the landlord's duty, and the verdict went to P. D appealed.
