Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Felice executed a warranty deed to L.C. and J.F., her nephews, conveying certain land in Pulaski County. There was nothing special about the deed. Under an agreement with J.F, L.C. went into possession of the property and remained so until 1948 when he died. In 1949 this suit was filed alleging that the deed was made by Felice such that L.C. and J.F would hold the property as trustees for themselves and their brothers and sisters. This trust agreement was sought to be impressed on the property against the widow and heirs of L.C. The Chancery Court rejected the evidence and dismissed the complaint. This appeal resulted.
