Facts

P stated in her affidavit that D was obligated to pay $100,000 upon the execution of the agreement, $1,000 per month for life, and $50,000 one year from the date of the execution. By the time P filed this action, the $150,000 in payments were barred by the statute of limitations. However, P relied upon a letter sent by D to P with relevant parts listed in the Fuller book 6th edition page 167.
