Facts

In 1925, Jessie became Herbert's secretary and continued as such until his death. In 1931, Herbert purchased an Investment Annuity Policy from Kansas City Life for $50,000 with income payable to him and the principal payable to his wife at his death. Herbert was then 72. After his wife died, Herbert named Jessie the beneficiary of the policy. He died in 1941, and this dispute erupted between the estate and Jessie over who had rights to the proceeds. The trial court ruled for Jessie. This appeal resulted.
