Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Ps are Ohio corporations that own, operate, and lease a fleet of commercial trucks. D -- a Delaware corporation with its principal place of business in Illinois -- manufactures commercial trucks. D distributes its trucks through authorized dealers like Defiance Truck Sales & Service, Inc. (the Dealer), which is based in Ohio. Ps purchased or leased sixty-five Navistar trucks from the Dealer. The trucks began to break down shortly afterward and in 2015 sued D and the Dealer in Ohio state court. Ps voluntarily dismissed the suit and refiled against the same defendants in 2016. Over the next two years and four months, the case endured a motion for judgment on the pleadings, discovery, and a motion for summary judgment. In March 2019, as the summary judgment motion was pending Ps voluntarily dismissed the Dealer, leaving D as the only defendant. D removed and Ps moved to remand.
