Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Ps were the minor daughters of Claude Kreigh, aged 18, 16, and 10. Bertha Cogswell (D) is a creditor of Claude who obtained judgment against him. In execution of that judgment, the sheriff levied upon certain sheep, fifteen in all, and sold them in satisfaction of the debt. Ps claim that the sheep were their separate property given to them as young lambs and were bum so were given to them as gifts for which they raised them and raised their offspring. D argues that the property was acquired for the benefit of the father as the earnings of minor children belong to the father. The trial court gave judgment to Ps and D appealed.
