Facts

Cincinnati Corp (D) manufactures press brakes for bending metal. D sold one of its machines to Hutchinson Manufacturing. Lambertson (P) was an employee of Hutchinson and was assisting another employee in the operation of the press brake. P reached under the machine to retrieve a piece of metal, and the other employee neglected to remove his foot from the foot pedal. P's arm was crushed. P got workers' compensation from Hutchinson and then sued D. The trial court eventually ordered judgment against D for $34,000 and denied D's claim for contribution or indemnity from Hutchinson. D appealed.
