Facts
The Scott County Board of Supervisors was petitioned by Davenport Shooting Association for the rezoning of a 223-acre parcel of land from Agricultural 1 (A-1) to Agricultural 2 (A-2). The parcel was surrounded by land zoned under A-1. Davenport stated that it intended to build two uninhabited structures for recreational club use with the balance of the land to stay agricultural. Adjacent property owners opposed the petition. The Zoning and Planning Commission split the vote on the issue, but the Board of Supervisors voted 3 to 2 to approve the petition. The neighboring landowners contended that the rezoning constituted illegal spot zoning and took this lawsuit to enjoin the acts.
