Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

U.S. Steel (D) closed two large steel production facilities and laid off the workers. The trade union (P) sued to enjoin the closure or at least force D to sell the facilities to P. D claimed that the facilities were unprofitable and asserted an absolute right to make a business decision to discharge its employees and abandon the facility. D was initially restrained from closure, but a formal opinion was entered holding the plants were unprofitable and denied all relief. P appealed.
