Facts
Batley was the agent and manager of the Earl and in the course of that employment committed a breach of an injunction even though he had been served with the specifics of the injunction that was ordered against the Earl. P filed a motion to commit Batley to prison for his knowing violation of the court order. This first motion failed as a result of a technical objection; that it omitted the words “servants and agents.” P then filed another action against Batley for knowingly assisting in the breach of an injunction.
