Facts
Perkins invented an improvement to a water pump and got a patent for it. He sold the patent to P. Baker invented a similar improvement and got a patent on it. Baker sold it to D. P sued D for infringement. D asserts that P's invention is neither new nor useful and that the pumps used by him are not of the same construction as those of Mr. Perkins, but are a new invention of Mr. Baker.
