Facts

In 1981 Congress amended the food stamp program to provide that no household shall become eligible to receive food stamps while any one of its members is on strike. This was a challenge to that amendment. The appeals court declared the amendment unconstitutional on three different grounds; First Amendment and Equal Protection.
