Marriage Of Hebbring
255 Cal. Rptr. 488 (1989)
Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
H and W had been married for two years, two months, and had no children when they separated on January 2, 1984. W filed for dissolution on October 3, 1984. On February 21, 1985, W obtained a temporary restraining order precluding H from disposing of her separate property jewelry, which he had taken. H filed a declaration stating he had thrown W's jewelry into the sea after separation when it appeared no reconciliation would occur. W asked the court to reimburse her for the loss. It found the jewelry was her separate property and ordered H to reimburse her the stipulated value, $ 5,100, from his share of the community property. H contends the trial court lacked jurisdiction in a dissolution action to award W what he claims were damages for the tort of conversion. H appealed this issue.
