Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Milliken (P) sued Meyer (D) in Wyoming court and got a judgment. D then brought an action against P in Colorado seeking a decree that the Wyoming judgment was a nullity for want of jurisdiction. The lower Colorado court found the judgment valid. The Colorado Supreme Court held the Wyoming decree void on its face because of an irreconcilable contradiction between the findings and the decree. D was domiciled in Wyoming but was served in Colorado under a Wyoming statute giving long-arm jurisdiction. The Supreme Court granted certiorari.
