Facts

P is an illegal immigrant. He arrived in 1990 and stayed past his visa. P works as a car mechanic. On his own time, P replaced the air suspension in a 1990 Town Car owned by his friend. He lifted the car with a tire jack provided by D. The jack collapsed because the internal threads were stripped. P was injured and sued D. P sued for product liability and failure to warn. D filed its motion to amend to assert affirmative defenses.
