Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

The decedent was 19 years and 10 months old, unmarried, and living with his parents when he was killed in an auto accident. The parents sued under wrongful death and judgment was entered for $12,500. Ps appealed; the judgment was inadequate and was the result of the trial court erroneously refusing to admit evidence that Ps could reasonably have expected pecuniary benefits from their son after he reached the age of majority. The Court of Appeals agreed with Ps but transferred the case to this court.
