Facts

A fire occurred, and several ships docked in the harbor were destroyed. Noble (P) was the owner of one of the destroyed ships. To recover for his damages P sued several parties. One of them was D1 who was the last defendant served. D1 was served after P filed an amended complaint and more than 10 months after the filing of the original complaint. Invoking admiralty jurisdiction, D1 removed the suit to federal court. The federal court remanded back to state court for the failure of all the defendants to join in the removal. D1 filed a supplemental notice of removal.
