Office Depot, Inc. v. Zuccarini
621 F. Supp. 2d 773 (2007)
Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
P got a judgment against Ds in the amount of $100,000 with an additional $5,600 due in attorney's fees. P assigned the right to receive all payments including interest, to DS Holdings. The Court issued a Writ of Execution of Judgment, pursuant to California Code of Civil Procedure section 699.510, for the recovery of Ds' outstanding debt. The Court issued an order requiring the production and preservation of documents relating to Ds' substantial domain name portfolio. It then denied, as procedurally improper, a request by DS Holdings to add pseudonyms used by Di to the Writ of Execution of Judgment. The Court denied DS Holdings' request for a turnover order from the Court requiring third-party domain name 'registrars' to turn over internet domain names owned by D. DS Holdings now seeks the appointment of a receiver.
