Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Reno Escrow (P) was assigned the right to collect payment for legal services rendered over a five-year period to Old West (D). P sought summary judgment for $6,836.89 from D for an account stated; D's failure to object to the legal bills was an inference that this was the correct amount. D contended that the bills were excessive; its alleged silence created only a rebuttable inference of an account stated. P was awarded a summary judgment. P appealed.
