Facts
Drew (D) engaged in an altercation with another bar patron over the alleged theft of money left at the bar to pay for D's drinks. The police were called to stop the fights. In the course of restraining and investigating the fight, an officer was struck by D. D was charged with battery on a police officer and with disturbing the peace. D pleaded not guilty by reason of insanity. Under the M'Naghten test for insanity, D was found to be free of any mental defect and found to be sane. D appealed.
