Facts

Hickman (D) and several others committed a burglary. As they were leaving, they were met by police. They fled and were chased by the policemen. One officer accidentally killed another officer, who he believed to be one of the suspects. D found guilty of the crimes of murder, burglary and criminal damage to property. D filed a motion to arrest the judgment of guilty of murder and burglary. This motion was partially granted by the trial court in that the judgment of guilty for the crime of murder was arrested. D was placed on probation for the offense of burglary for a period of two years, and as a term of probation, he was ordered to serve nine months. P appealed.
