Facts
An investigator hired by Home Insurance Co. (D) was charged with theft for procuring the confidential medical records of two Denver hospital patients. The investigator got a verbatim reading of the records over the phone. D was charged with theft. The trial court granted a motion to dismiss; the confidentiality of records was not a thing of value. The State (P) appealed.
