Facts

Hutchison (D) was involved in a car accident. During the investigation of the accident, a bottle of whiskey was found in the area separating the driver and passenger seats. The court refused D's jury instruction regarding his knowledge of the container after a passenger had placed it there. D was convicted for illegal transportation of an open alcoholic beverage. This was a strict liability offense. D appealed, claiming that he had no knowledge of the container because a passenger had put it there.
