Facts

Lynes (D) did a large number of bad things to the complainant who happened to observe D in Harlem. When she recognized D as her assailant, D took off and ran into a tenement house. Detective Longo then went after D and eventually discovered D's brother's apartment wherein the detective told D's brother to have him call him and left his card. A few hours later a person identifying himself as Speedy Julias Lynes called and inquired as to why Longo wanted him. Longo replied that Speedy's knife had been found at the scene of the crime. Speedy replied, 'Oh no oh no.' The detective asked Speedy to come into the station, and Speedy replied, 'You are going to have to find me.' During trial, the prosecution wanted this evidence admitted. D objected in that Longo was unfamiliar with the voice and therefore could not personally identify it as that of D. D was convicted and appealed.
