Facts

Martin (D) was charged by information with two counts of horse racing bookmaking and two counts of keeping premises for purposes of bookmaking. The trial court granted D's motion to set the information aside based on the determination that the evidence against him was seized in violation of his constitutional rights; an illegal seizure. D disclaimed an interest in the premises searched and the property seized.
