Facts

Washburn (D) was charged with a violation of a statute for the intentional failure to return rental property within 72 hours after an agreed upon time for return. The statute was later amended, changing the word from intentionally to knowingly. D was charged with violation of the amended statute. The trial court declared that statute to be unconstitutional because it did not require a criminal intent. The trial court dismissed the charges. The State (P) appealed.
